These Terms of Service govern your use of frattybear.com and any products or services you order from Fratty Bear, a brand of Kustom Life Co ("Fratty Bear," "we," "us," or "our"). By using this site or placing an order, you agree to these terms.

1. About Us

Fratty Bear is a brand of Kustom Life Co, located at 6801 Pacific Blvd, Huntington Park, CA 90255, with a studio at 14537 Garfield Ave, Paramount, CA 90723. We produce custom apparel and merchandise for fraternities, sororities, clubs, and campus organizations.

2. How Orders Work

We do not sell through automated checkout on this website. All orders are custom and follow this process:

1. You request a quote through our website, by phone, by text, or in person.
2. We send you a written quote covering products, quantities, decoration method, pricing, and estimated timeline.
3. You approve the quote and pay any required deposit.
4. We send you a digital proof of your artwork.
5. You approve the proof in writing. Production does not begin until we have your written approval.
6. We produce and deliver or make your order available for pickup.

A quote is not a confirmed order. An order is confirmed only when you have approved the quote, paid any required deposit, and approved the proof.

3. Pricing and Payment

Quotes are valid for 30 days unless stated otherwise. Prices depend on quantities, decoration method, garment availability, and turnaround time. We may require a deposit before production begins, with the balance due before delivery or pickup. Payment terms are stated on each quote or invoice. Prices do not include applicable sales tax or shipping unless stated.

4. Artwork, Trademarks, and Your Responsibilities

This section matters, so please read it.

By submitting artwork, letters, crests, logos, names, or any other design to us, you represent and warrant that:

• You own the rights to that artwork, or you have written permission from the owner to reproduce it;
• If the design includes the letters, insignia, crest, or name of a fraternity, sorority, university, or other organization, you have the authority and any license required from that organization to have the items produced;
• Production of your order will not infringe any trademark, copyright, or other right of a third party.

You agree to indemnify and hold Fratty Bear and Kustom Life Co harmless from any claim, damage, or cost arising from artwork you submit to us.

We may decline any order at our discretion, including orders we believe may infringe a third party's rights or that contain content we consider offensive.

5. Proofs, Colors, and Variations

You are responsible for reviewing your proof carefully, including spelling, names, letters, sizes, quantities, and placement. Once you approve a proof, you accept responsibility for its contents, and we are not liable for errors it contained.

Screen and monitor colors vary. Printed and embroidered colors may differ slightly from what you see on your device. Garment shades may vary between production runs and between brands. Slight variation in print placement is normal in apparel decoration and is not considered a defect.

6. Turnaround and Delivery

Timelines quoted are estimates and begin from the date of proof approval and receipt of any required deposit, not from the date of your original inquiry. Rush service may be available for an additional fee. We are not responsible for delays caused by shipping carriers, supplier stock shortages, weather, or other events outside our control. If you have a hard deadline such as a rush event, bid day, or formal, tell us before you approve the quote.

7. Cancellations, Changes, Returns, and Refunds

Because every item is made to order:

• Changes or cancellations may be accepted before proof approval and may incur costs already committed, including artwork and garment purchases.
• Once a proof is approved and production has begun, orders cannot be canceled and are not refundable.
• Custom items are final sale. We do not accept returns or exchanges for size, color, or change of mind.
• If an item is defective or does not match your approved proof, contact us within 7 days of receipt with photos. We will replace, reprint, or refund the affected items at our discretion.

8. Text Messages and Communications

If you provide your mobile number and consent, you may receive text messages from us as described in our Privacy Policy. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe and HELP for help. Consent is not a condition of purchase.

9. Intellectual Property of This Site

The Fratty Bear name, logo, site design, photographs, and written content are owned by Kustom Life Co and may not be copied or used without our written permission.

10. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim related to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages, including lost profits or missed events.

11. Governing Law

These terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California.

12. Changes to These Terms

We may update these Terms of Service from time to time. The effective date at the top of the page will reflect the most recent version.
